Thumbnails Are Fair Use

“Perfect 10″ is a, ahem…”gentleman’s magazine” or Adult Publisher of scantily clad women that had no cosmetic surgery and are very attractive. Link to the site, mildly NSFW.
Perfect 10 is also very protective of the pictures on their web site, and when GOOG started caching thumbnail pics of the ladies for their image search to link to, in Aug 2006 Perfect 10 did what any self respecting publishing company would do – take GOOG to court for copyright infringement over the thumbs.
LATimes is reporting that this week a Court of Appeals “reaffirmed its earlier support for the socially redeeming value of searching the Internet for nudie pictures.”
Fair use is a doctrine in United States copyright law that allows limited use of copyrighted material without requiring permission from the rights holders.
